The appointment of amicus curiae in regard to the retention of bulk metadata

On September 17, FISC Judge Michael W. Mosman appointed Preston Burton as amicus curiae, pursuant to 50 U.S.C. Sec. 1803(i)(2)(B), to assist in deciding on the government’s request to retain bulk metadata for litigation purposes after November 28, 2015, in accordance with the Opinion and Order of March 12, 2014 in BR 14-01. Mr. Burton was also appointed to assist in deciding whether for a period ending on February 29, 2016, properly trained and authorized NSA agents would be allowed to access bulk metadata in order “to verify the completeness and accuracy of call detail records” produced in response to FISC targeted collection orders after November 28, 2015.
