Reauthorization of the telephony metadata program on January 3, 2014

On February 12, 2014, after the Government completed its declassification review, the FISC released a redacted version of FISC Judge Thomas Hogan’s Primary Order of January 3, 2014 reauthorizing the telephony metadata program. Although the Primary Order was not accompanied by an opinion, Judge Hogan stated that his decision to reauthorize the program was informed by FISC Judge Eagan’s and McLaughlin’s opinions and by the federal district court decisions in ACLU v. Clapper, 959 F.Supp.2d 724 (SDNY 2013), and Klayman v. Obama, 957 F.Supp.2d 1 (D.D.C. 2013), discussed in separate posts.
