Europe v. Facebook filed complaints

On June 26, 2013, Europe v. Facebook filed complaints (available in German only) with Luxembourg’s National Commission for Data Protection (the “CNPD”) against Skype’s and Microsoft’s subsidiaries in Luxembourg in regard to their transfer of Europeans’ data to the NSA under the Prism program. In a news release on November 18, the CNPD stated that, “The fact finding operations conducted since July 2013 and the subsequent detailed analysis did not bring to light any element that the two Luxembourg-based companies have granted the U.S. National Security Agency mass access to customer data.” The CNPD further stated that Microsoft’s and Skype’s self-certification under the Safe Harbor Agreement made their transfer of Europeans’ data to the US legal.
